Spring Partners Licensing LLC (“Us” or “We” our “Our”) provides the Wash and Run Car Wash Subscription mobile application (the “App”) and other various related services to you, the user (“You” or “Your” or “User”), subject to your compliance with all terms, conditions, and notices contained or referenced herein (the “Terms of Use”) as well as any other written agreement between Us and You. By accessing, downloading or using the App or the related services, You signify your acceptance of all provisions of these Terms of Use and all features and functionalities, App, user interfaces, and all content and software associated with our services and the App. THESE USER TERMS CREATE A BINDING LEGAL AGREEMENT BETWEEN YOU AND US. If you do not agree to these Terms of Use, please exit the App and cancel your membership. If you have questions or concerns regarding these Terms of Use, please contact Us as directed below.
We expressly reserve the right to make changes to these Terms of Use and any other terms at any time without notice to You including, without limitation, changes in pricing in our sole and absolute.
Your continued membership and use of our App following any changes to these Terms of Use means that You accept such changes. The Wash and Run Car Wash Subscription is a subscription based car wash membership and is for the individual user and vehicle that is registered with Us. This Agreement commences on the date of registration and, if a membership is purchased, continues from month to month until cancelled or terminated in accordance with these Terms of Use.
You represent and warrant that You: (a) are not under the age of 18; (b) are not registering under a false name or with false information; (c) are authorized to use the form of payment submitted for membership; (d) will not use other members’ accounts and will not let others use Your account; (e) will not attempt to or actually override any security component included in the App; and (f) will comply with these Terms of Use and Our other policies and procedures at all times.
You, as the individual who created the membership account, have access and control over Your membership account through the use of an identification name and password. You have exclusive control over such information. Because Your account will contain credit card information, You should not reveal such information to anyone. By sharing such information, You agree to be responsible for the misuse of such information.
General Policies:
The Wash and Run membership is valid only at participating Wash and Run locations.
The Wash and Run membership is valid for the specified services only.
The Wash and Run membership is valid for up to one car wash per day for the designated vehicle only.
To use Your Wash and Run membership, You must have your smartphone device with the downloaded Wash and Run App with you at the time the services are to be rendered.
A valid credit or debit payment card is required to participate in the Wash and Run membership program.
All vehicles must conform to Wash and Run’s and each individual location’s standards. Modifications outside of such standards to an existing customer’s vehicle may result in Your inability to participate and require termination. You should carefully read the instruction sign present at each location for confirmation that Your vehicle meets Our standards.
We have the ability to require license plate collection upon account creation.
Oversized vehicles are not permitted to participate in the Wash and Run program.
The Wash and Run program is not applicable for commercial and/or professional use vehicles.
Payment and Billing:
You understand and agree that by participating in the Wash and Run program, You authorize Us to charge Your credit card account on a monthly basis on the anniversary date of Your original purchase/registration until Your membership is terminated as provided herein. Your credit card will be charged immediately if You use the App for a single wash.
In addition to the payments for services, You will also be charged for applicable taxes and a $1.30 digital transaction fee ($0.45 for each single wash).
No credit or refund will be given for partial use in a month.
You may upgrade or downgrade Your subscription at any time via the App.
We may terminate Your membership at any time for Your failure to comply with Our policies and procedures or these Terms of Use with no credit or refund requirements. We reserve the right, in Our sole discretion, to refuse to honor any request for membership.
You may cancel your Wash and Run program membership at any time by accessing Your account on the App and cancelling Your subscription. You may also contact Us as directed below. Your membership will be cancelled effective one (1) day from Your NEXT bill date. You will continue to have access to the service through the end of Your next billing period.
The Wash and Run equipment is mechanical and may occasionally be unavailable due to repairs, maintenance or weather-related events. There are no refunds, credits, or adjustments for days that the car wash is unavailable.
The Wash and Run program is per vehicle and for personal use only. Taxis, limousines and other for-hire professional vehicles are prohibited. The program cannot be used in conjunction with any other car wash-related discount offers or coupons unless We make the same available on the App. All general rules, regulations and disclaimers of liability posted on signs at our car wash locations or on the App apply to the Wash and Run program.
By registering as a member in the Wash and Run membership program, You acknowledge that the subscription is only valid at the location(s) indicated by the subscription description.
To the extent permissible under applicable laws and jurisdictions, in no event shall We or Our subsidiaries or any of their shareholders, directors, officers, employees or licensors be liable (jointly or severally) to You for personal injury, property damages or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever as a result of your use of the services offered by Us.
